By registering for any of the services offered by the Courchevel Golf Club, as described in our offer, you fully and unreservedly accept our General Terms and Conditions of Sale (GTC) as well as the specific terms and conditions applicable to the Courchevel Golf Club.

1. Preamble

1.1. These terms and conditions are agreed between, on the one hand, the Courchevel Golf Club Association, registered under SIRET number 34807005300015, and Intra-Community VAT number FR30348070053, whose registered office is situated at 540 rue du Jardin Alpin, 73120 Courchevel, hereinafter referred to as “Courchevel Golf Club”, and, on the other hand, natural persons wishing to make a purchase via the Courchevel Golf Club website www.golfdecourchevel.com, hereinafter referred to as the “Customer”.

1.2 Any order implies acceptance of these general terms and conditions of sale.
The sales contract is subject to French law.
Orders can only be placed between the Courchevel Golf Club and a non-trading individual.

1.3 Courchevel Golf Club reserves the right to modify these terms and conditions at any time by publishing a new version on its website www.golfdecourchevel.com.
Consequently, it is necessary that they be reread before each visit or purchase on the website. Each purchase on the site is governed by the general conditions applicable on the date of the order. Before validating an order, the customer must have read these general conditions of sale, which is confirmed by the fact that he checked the box “I have read the General Conditions of Sale and accept them”. 2. Products - Offers

2.1. The products presented on the www.golfdecourchevel.com website are those described on the website.
The Courchevel Golf Club Association takes the greatest care in the presentation and description of these products in order to provide the Customer with the best possible information. However, it is possible that non-substantial errors may appear on the site, which the Customer acknowledges and accepts.
In any event, in the event of non-conformity of the product delivered in relation to its description on the site, the Customer may either exercise his/her right of retraction, or invoke the Courchevel Golf Club Association’s guarantee of conformity, which will proceed, where appropriate, either to an exchange or to reimbursement of the price (or part of the price) that may have been invoiced.

2.2. The sales offers, consisting of the presentation of the products and the prices indicated, are valid while stocks last.
The offers on the www.golfdecourchevel.com website are valid for delivery in mainland France only.

3. Order

3.1. The Customer may, at any time, request additional information before placing an order, by sending an e-mail to info@golfdecourchevel.com, indicating the product reference.
Any order implies unreserved acceptance of these general terms and conditions of sale, the price and the product indicated on the website.

3.2. When placing an order, the Customer must enter all his/her contact details so that the Courchevel Golf Club can ensure delivery of the products ordered.
The information collected when the order is placed is necessary to process the order.

3.3. The contract of sale is concluded upon delivery to the carrier but under the condition precedent of the collection of the sale price (see below “Transfers of ownership”).

3.4. If the product ordered is unavailable, the Customer will be informed within 72 hours, working days.
They will then be offered an exchange.
The Customer may also request a refund by sending a written request to info@golfdecourchevel.com.
The refund will be made within a maximum of 30 days.

3.5. Once the order has been validated, the Customer will be assigned an order number and will receive a summary document by e-mail from the latter, to the e-mail address he indicated when placing the order. This document, valid as an acknowledgement of receipt, sets out all the constituent elements of the contract between the Courchevel Golf Club and the Customer.
The order form is recorded on the registers of the Courchevel Golf Club, which are themselves kept on a reliable and durable medium.
The Customer accepts that it will be considered as proof of the contractual relationship between Courchevel Golf Club and the Customer.

3.6. The Customer is invited to check the information contained in this document, in particular the delivery address.
The Courchevel Golf Club cannot be held responsible for any typing errors and the consequences thereof (delays, delivery errors or returned parcels).
Any costs incurred in re-sending the order will be charged to the Customer.

3.7. The Golf Club de Courchevel reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning the payment of a previous order, or in the event of failure to receive supporting documents or incomplete supporting documents.

4. Price

4.1. The prices indicated on www.golfdecourchevel.com for each of the products marketed by the Courchevel Golf Club are indicated and payable in euros.
They include all taxes.
They are only applicable to distance sales concluded from this website. The Courchevel Golf Club reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time the order is registered.
The products and services sold on www.golfdecourchevel.com are strictly reserved for private individuals.

4.2. Delivery charges are calculated according to a scale that takes into account the weight, size and volume of the order.
Please note that deliveries are only made in Metropolitan France.

5. Payment

Customers may only pay for their order by credit card or PayPal.
Payment is made in cash when the order is placed by bank card, without discount.
The Customer must provide their bank card number, expiry date and security code (the last three digits on the back of the card, to the left of the signature).
The transaction is secure. SSL encryption is provided by Paypal or Credit Agricole (depending on payment choices).
If an incident occurs during the registration of the order, it is null and void and the Customer must repeat the ordering procedure.
At no time does the Customer’s banking data pass through the Courchevel Golf Club’s computer system.

6. Delivery and availability

6.1. Delivery is made to the delivery address indicated by the customer, it being specified that this must be the residence address of the customer or any other natural person of his choice domiciled in Metropolitan France.

6.2. In order to meet these deadlines, the customer must ensure that they have provided accurate and complete information regarding the delivery address (such as street, building, staircase, access codes, names and/or intercom numbers, etc.).

6.3. The times indicated are indicative times, corresponding to average processing and delivery times.
The Courchevel Golf Club Association cannot be held responsible for the consequences of a delay in delivery for which it is not responsible.
In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and the Courchevel Golf Club Association, by any means, of any reservations within 3 days of receiving the product.

6.4. The Golf Club of Courchevel also invites the Customer to contact the Customer Service by e-mail at info@golfdecourchevel.com for any questions or problems.

7. Withdrawal period - Returns - Exchange

7.1. In accordance with the provisions of the French Consumer Code, the Customer has a period of seven clear days, starting from the day of delivery of the goods ordered, to exercise his/her right of withdrawal without having to justify his/her reasons or pay any penalties, with the exception of the cost of returning the goods, which will be borne by the Customer.
UNOPENED products must be returned to the following address: Courchevel Golf Club, 540 rue du Jardin Alpin 73120 Courchevel.

7.2. In case of exercise of the right of withdrawal, the Golf Club of Courchevel is obliged to reimburse the customer (at the latest within 30 days of the date on which this right was exercised).
However, the customer must inform the Golf Club of Courchevel by contacting the customer service by email of his intention to use his right of withdrawal.

7.3. Unless there is a legitimate reason, any claim made after 7 days following receipt of the Products will be considered inadmissible and the Courchevel Golf Club will not be held liable under any circumstances.
The Courchevel Golf Club reserves the right to ask the Customer to return the non-conforming or damaged product.
In the event of abnormal or abusive returns, the Courchevel Golf Club may refuse to accept a subsequent order.

8. Transfer of Ownership

The transfer of ownership is subject to full payment of the price by the buyer.
However, if the delivery of the product or products ordered from the carrier takes place before full payment, the buyer will bear all risks that the thing may cause or suffer, for any reason whatsoever, from the delivery to the carrier.
In all cases, the product or products ordered travel at the risk and peril of the Customer to which it belongs, in case of damage or shortage, make any necessary finding and confirm its reservations by means of an out-of-court document or by registered letter with acknowledgement of receipt with the carrier within two days of receipt of the goods.

9. Personal data

9.1. The Customer’s personal data is essential for the processing of his/her requests.
The Courchevel Golf Club reserves the right to use these details for the purposes of commercial promotions or any other events organised by the Courchevel Golf Club or any other company or association, in strict compliance with the French Law on Confidence in the Digital Economy (LCEN).

9.2. However, pursuant to the French Data Protection Act (Law of 6 January 1978, as amended by Law no. 2004-801 of 6 August 2004), the Customer has the right to access, modify, rectify and delete the data concerning him (art. 40 of the amended Law).
To exercise this right, the Customer must contact: Golf Club de Courchevel, 540 rue du Jardin Alpin 73120 Courchevel, indicating his last name, first name and address.

10. Completeness

In the event that one of the provisions of this contract is null and void by a change of law, regulation or court decision, this shall not affect the validity and compliance with these general conditions of sale.

11. Duration

These terms and conditions apply for the entire duration of the services offered by the Courchevel Golf Club.

12. Liability

12.1. The Golf Club of Courchevel could not be held liable for any inconvenience or damage related to the use of the internet network, such as a break in the service, the presence of computer viruses or external intrusions, or more generally any case deemed by the courts to be force majeure.

12.2. The products offered comply with the French or European legislation in force and the standards applicable in France or within the European Union.
The liability of the Golf Club of Courchevel cannot be incurred in case of non-compliance with the legislation of the country where the product is delivered (for example in case of prohibition of a product…).
It is up to the Customer to check with the local authorities the possibilities of importing or using the products or services he intends to order.
The Golf Club of Courchevel cannot be held responsible for any indirect damages that may arise from the purchase of the products.

12.3. The products and services sold on www.golfdecourchevel.com are strictly reserved for private individuals.
In the case of professional purchases, the Courchevel Golf Club will not be held liable for any indirect damage, operating loss, loss of profit, loss of opportunity, damage or costs that may result.

13. Claims

All complaints must be made by email to info@golfdecourchevel.com or by mail to Golf Club de Courchevel, 540 rue du Jardin Alpin, 73120 Courchevel.

14. Settlement of disputes

In case of dispute, an amicable solution will be sought before any legal action. Otherwise, any legal action will be brought before the competent courts of the place of delivery or that of the Customer’s domicile according to the preferences of the latter.
These conditions are subject to French law.

15. Acceptance of the General Terms and Conditions of Sale

By clicking on the “validate” button of the order process, the Customer acknowledges having read and accepted the General Terms and Conditions of Sale and accepts them irrevocably and without reservation.
From this moment, the order is considered validated subject to the collection of the total price that must be paid at the order as stated above.
If payment is not made, the order is considered null and void.

16. Force Majeure

16.1. The Golf Club of Courchevel will not be responsible for the total or partial non-performance of its obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular in the event of a total or partial disturbance or strike, in particular by its logistics subcontractors, postal services, means of transport and/or communication, flooding or fire.

16.2. The Courchevel Golf Club will notify the Customer of an event constituting force majeure within 5 working days of its occurrence and will determine the terms and conditions for processing the order for the duration of the case of force majeure.
After a period of 1 month of interruption due to force majeure, the Parties will be released from their obligations towards each other. If necessary, the Courchevel Golf Club will reimburse the Customer as soon as possible.

17. Organised trips - Specific conditions

17.1. Purpose and scope of stays
The Courchevel Golf Club occasionally organises golf breaks or events for its members and registered participants, which may include all or some of the following services: accommodation, green fees, meals, transfers, additional activities or other complementary services.
These trips are organised within a voluntary and events-based framework, in the the interests of members of the club, and rely on the involvement of third-party providers (hotels, airlines, airlines, transport operators, golf courses, restaurants, incoming agencies or other suppliers).
The Courchevel Golf Club of acts solely in the capacity of organiser and coordinator of services booked with these service providers.
The specific terms and conditions for each trip (destination, programme, price, terms of payment, specific conditions) are provided in advance of registration and form an integral part of the contractual agreement.

17.2. Registration and the nature firmness of the commitment
Any booking for a holiday becomes firm and final once the booking has been confirmed and the required deposit has been paid.
By registering, you fully and unreservedly accept these Terms and Conditions of Sale, as well as any specific terms and conditions relating to the stay in question.
As places are generally limited and the Courchevel Golf Club has to make immediate financial commitments to its service providers, all bookings are final.

17.3. Payment
Registration requires the payment of a deposit, the amount of which will be specified when registration opens.
The balance must be paid within the timeframe communicated to the participant.
If the balance is not paid within the specified timeframe, the Courchevel Golf Club may consider the registration automatically cancelled, without refund of the deposit paid, which will be retained to cover the commitments made.
The Courchevel Golf Club reserves the right to refuse access to the holiday to any participant who has not paid the full amount due.

17.4. Cancellation by the participant
Any cancellation made by the participant must be notified in writing.
Unless expressly provided for under a personal insurance policy taken out by the participant or by way of an exceptional agreement with the Courchevel Golf Club:
– the deposit paid shall be retained by the Courchevel Golf Club;
– any sums already committed or which cannot be recovered from service providers remain payable;
– any refund of recoverable sums depends exclusively on the terms and conditions applied by the service providers concerned.
The participant may propose a replacement, subject to the prior approval of the Courchevel Golf Club and subject to the operational feasibility as confirmed by the service providers.
Any costs incurred in connection with this replacement shall be borne by theoriginal participant or the replacement.

17.5. Amendment or cancellation by the Courchevel Golf Club
The Courchevel Golf Club reserves the right to cancel or amend a booking in the event of:
– insufficient number of participants;
– unavailability or failure of a service provider;
– logistical constraints;
– safety reasons;
– exceptional weather conditions;
– force majeure;
– or any external circumstances preventing the smooth running of the trip.
In the event of cancellation by the Courchevel Golf Club prior to departure, any sums paid will be refunded, subject to deduction of any costs that have been irrevocably incurred and are non-refundable by the service providers.
No additional compensation may be claimed.
In the event of a substantial change, the participant will be informed as soon as possible.

17.6. Changes to the programme
The itinerary, the order of activities, timetables, accommodation, golf courses or certain services may be subject to change before or during the holiday for technical, weather-related, safety or organisational reasons.
The Courchevel Golf Club will endeavour to provide an equivalent service, without this constituting grounds for a refund or a claim, unless an essential service is completely cancelled and not replaced.

17.7. Liability of the participant
Each participant remains personally responsible:
– for the validity of their identity documents, travel documents and visas or administrative formalities;
– their physical fitness to take part in the trip;
– compliance with local rules, of the internal regulations of the establishments visited and of the instructions from the organisers ;
– for his personal belongings, luggage, equipment or items of value.
The Courchevel Golf Club shall not be held liable for the consequences arising from failure to comply with administrative or personal requirements of the participant.

17.8. Insurance
It is the responsibility of the participant to check their personal insurance cover.
The Courchevel Golf Club strongly recommends taking out insurance covering:
– cancellation;
– assistance;
– repatriation;
– civil liability;
– luggage.
In the absence of cover, the participant shall bear sole responsibility financial consequences arising from an prevention or personal incident.

17.9. Limitation of liability
The Courchevel Golf Club cannot be held liable for any failures, delays, cancellations or non-performance attributable to third-party service providers involved in the holiday.
Its liability is strictly limited to its role in organisation and coordination.
In any event, it shall not be held liable for any indirect damage, loss of enjoyment, financial loss, delay, non-pecuniary damage or consequence arising from an event beyond its control.

17.10. Force majeure
No liability shall be accepted in the event of force majeure or unforeseeable circumstances rendering the holiday impossible or significantly more difficult to carry out, including:
natural disasters, adverse weather conditions, health crises, administrative closures, industrial action, strikes, war, travel restrictions, transport failures or any other circumstances beyond the control of the Courchevel Golf Club.
In such circumstances, any refunds will depend exclusively on the refunds obtained from the relevant service providers.
