General Conditions of Sale

Article 1. Preamble.

1.1. Les présentes conditions sont conclues entre, d’une part l’association du Golf Club de Courchevel, inscrite sous le numéro Siret 34807005300015, et le numéro de TVA Intracommunautaire FR30348070053 , dont le siège est situé 540 rue du Jardin Alpin 73120 Courchevel, ci-après dénommée ”Golf Club de Courchevel”, et d’autre part les personnes physiques souhaitant effectuer un achat via le site internet du Golf Club de Courchevel www.golfdecourchevel.com ci après dénommées le ”Client”.

1.2. Any order requires adherence to these general terms and conditions of sale.
The contract of sale is subject to French legislation.
Orders can only be placed between Golf Club de Courchevel and any natural person who is not a trader.

1.3. Golf Club de Courchevel reserves the right to modify this document at any time by publishing a new version on its website www.golfdecourchevel.com.
Therefore, it is necessary that these are reviewed before each visit or purchase on the website. Each purchase on the site is governed by the general conditions applicable on the date of the order. Before validating an order, the customer must have read these general conditions of sale, which is confirmed by the fact that he checked the box “I have read the General Conditions of Sale and accept them”. Article 2. Products - Offers.

2.1. The products on www.golfdecourchevel.com are those described on the site.
The association of the Golf Club of Courchevel takes great care in the presentation and description of these products to best satisfy the information of the Customer. However, it is possible that non-substantive errors may appear on the site, which the customer acknowledges and accepts.
In any case, in case of non-compliance of the product delivered in relation to its description on the site, the Customer may either exercise its right of withdrawal or implement the guarantee of conformity of the association of the Golf Club of Courchevel which will proceed, where applicable, either at the exchange or at the refund of the price (or partially) possibly invoiced.

2.2. The offers of sale, consisting of the presentation of the products and the prices indicated, are valid within the limit of available stocks.
The offers on the website www.golfdecourchevel.com are valid for delivery in Metropolitan France only.

Article 3. Order.

3.1. The Customer may, at any time, request additional information before placing an order, by sending an e-mail to info@golfdecourchevel.com, indicating the product reference.
Any order implies acceptance without reservation of these general conditions of sale, the price and the product indicated on the website.

3.2. When ordering, the Customer must enter all his contact details so that the Golf Club of Courchevel can ensure the delivery of the ordered products.
The information collected during the ordering process is necessary for the processing of the order.

3.3. The contract of sale is concluded upon delivery to the carrier but under the condition precedent of the collection of the sale price (see below “Transfers of ownership”).

3.4. In case of unavailability of the ordered product, the Customer is informed within 72 hours, working days.
He is then offered to make an exchange.
The Customer will also be able to request a refund by written request to info@golfdecourchevel.com.
The refund will be made within 30 days maximum.

3.5. Once the order has been validated, the Customer will be assigned an order number and will receive a summary document by e-mail from the latter, to the e-mail address he indicated when placing the order. This document, which constitutes an acknowledgement of receipt, contains all the elements constituting the contract between the Courchevel Golf Club and the Customer.
The order form is registered in the registers of the Golf Club of Courchevel, which are kept on a reliable and durable support.
The Customer accepts that it is considered as proof of the contractual relations between Golf Club de Courchevel and the Customer.

3.6. The Customer is asked to verify the information in this document, including the delivery address.
The Golf Club of Courchevel could not be held responsible for errors of entry and the resulting consequences (delays, delivery errors or returned packages).
The costs incurred for the redirection of the order will be borne by the Customer.

3.7. The Golf Club de Courchevel reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning the payment of a previous order, or in the event of failure to receive supporting documents or incomplete supporting documents.

Article 4. Price.

4.1. The prices indicated on www.golfdecourchevel.com for each of the products marketed by the Courchevel Golf Club are indicated and payable in euros.
They are shown with all taxes included.
They are only applicable for sales concluded remotely from this site. The Golf Club of Courchevel reserves the right to change its prices at any time but the products will be invoiced on the basis of the rates in force at the time of the order registration.
Products and services sold at www.golfdecourchevel.com are strictly for private individuals.

4.2. Delivery costs are calculated according to a scale integrating weight, size and volume of the order.
It is recalled that deliveries are made in Metropolitan France only.

Article 5. Payment.

The Customer can only pay by credit card or PayPal.
Payment is made by cash at the time of ordering by credit card, without discount.
The Customer must then indicate his bank card number, expiry date and the cryptogram (the last three digits, on the back of his card, located to the left of the signature).
The transaction is secure. SSL encryption is provided by Paypal or Credit Agricole (depending on payment choices).
If an incident occurs during the registration of the order, it is null and void and the Customer must repeat the ordering procedure.
At no time does the Customer’s banking data pass through the Courchevel Golf Club’s computer system.

Article 6. Delivery and availability.

6.1. Delivery is made to the delivery address indicated by the customer, it being specified that this must be the residence address of the customer or any other natural person of his choice domiciled in Metropolitan France.

6.2. In order to meet these deadlines, the customer must ensure that they have provided accurate and complete information regarding the delivery address (such as street, building, staircase, access codes, names and/or intercom numbers, etc.).

6.3. The deadlines indicated are indicative deadlines, corresponding to the average processing and delivery times.
The association of the Golf Club of Courchevel cannot be held responsible for the consequences due to a delay of delivery not being due to it.
In case of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and the association of the Golf Club de Courchevel, by all means, any reservations within 3 days of receipt of the product.

6.4. The Golf Club of Courchevel also invites the Customer to contact the Customer Service by e-mail at info@golfdecourchevel.com for any questions or problems.

Article 7. Withdrawal period - Return - Exchange.

7.1. In accordance with the provisions of the Consumer Code, the Customer has a period of seven clear days, which begins to run from the day of delivery of the ordered goods, to exercise his right to withdraw without having to justify, or to pay penalties, with the exception of return costs, which will be borne by the Customer.
UNOPENED products must be returned to the following address: Golf Club de Courchevel, 540 rue du Jardin Alpin 73120 Courchevel.

7.2. In case of exercise of the right of withdrawal, the Golf Club of Courchevel is obliged to reimburse the customer (at the latest within 30 days of the date on which this right was exercised).
However, the customer must inform the Golf Club of Courchevel by contacting the customer service by email of his intention to use his right of withdrawal.

7.3. Unless there is a legitimate reason, any complaint made after 7 days of receipt of the Products will be considered inadmissible and the Golf Club de Courchevel will not be liable under any circumstances.
The Golf Club of Courchevel reserves the right to ask the Customer to return the non-compliant or damaged product.
In case of abnormal or abusive returns, the Golf Club of Courchevel may refuse to accept a subsequent order.

Article 8. Transfer of Ownership.

The transfer of ownership is subject to full payment of the price by the buyer.
However, if the delivery of the product or products ordered from the carrier takes place before full payment, the buyer will bear all risks that the thing may cause or suffer, for any reason whatsoever, from the delivery to the carrier.
In all cases, the product or products ordered travel at the risk and peril of the Customer to which it belongs, in case of damage or shortage, make any necessary finding and confirm its reservations by means of an out-of-court document or by registered letter with acknowledgement of receipt with the carrier within two days of receipt of the goods.

Article 9. Personal data.

9.1. The data concerning the Customer are personal information essential for the processing of its requests.
The Golf Club of Courchevel reserves the right to use these details for the purposes of commercial promotions or any other events organized by the Golf Club of Courchevel or any other company or association, and this in strict compliance with the Law on Trust in the Digital Economy (LCEN).

9.2. However, pursuant to the French Data Protection Act (Law of 6 January 1978, as amended by Law no. 2004-801 of 6 August 2004), the Customer has the right to access, modify, rectify and delete the data concerning him (art. 40 of the amended Law).
To exercise this right, the Customer must contact: Golf Club de Courchevel, 540 rue du Jardin Alpin 73120 Courchevel, indicating his last name, first name and address.

Article 10. Completeness.

In the event that one of the provisions of this contract is null and void by a change of law, regulation or court decision, this shall not affect the validity and compliance with these general conditions of sale.

Article 11. Duration.

These terms and conditions apply for the entire duration of the services offered by the Courchevel Golf Club.

Article 12. Liability.

12.1. The Golf Club of Courchevel could not be held liable for any inconvenience or damage related to the use of the internet network, such as a break in the service, the presence of computer viruses or external intrusions, or more generally any case deemed by the courts to be force majeure.

12.2. The products offered comply with the French or European legislation in force and the standards applicable in France or within the European Union.
The liability of the Golf Club of Courchevel cannot be incurred in case of non-compliance with the legislation of the country where the product is delivered (for example in case of prohibition of a product…).
It is up to the Customer to check with the local authorities the possibilities of importing or using the products or services he intends to order.
The Golf Club of Courchevel cannot be held responsible for any indirect damages that may arise from the purchase of the products.

12.3. Products and services sold at www.golfdecourchevel.com are strictly for private individuals.
In the event of professional purchases, Le Golf Club de Courchevel will not incur any liability for any indirect damages resulting from the foregoing, loss of operations, loss of profit, loss of chance, damage or expenses, which may result.

Article 13. Complaint.

All complaints must be made by email to info@golfdecourchevel.com or by mail to Golf Club de Courchevel, 540 rue du Jardin Alpin 73120 Courchevel.

Article 14. Dispute Resolution.

In case of dispute, an amicable solution will be sought before any legal action. Otherwise, any legal action will be brought before the competent courts of the place of delivery or that of the Customer’s domicile according to the preferences of the latter.
These conditions are subject to French law.

Article 15. Acceptance of the General Conditions of Sale.

By clicking on the “validate” button of the order process, the Customer acknowledges having read and accepted the General Terms and Conditions of Sale and accepts them irrevocably and without reservation.
From this moment, the order is considered validated subject to the collection of the total price that must be paid at the order as stated above.
If payment is not made, the order is considered null and void.

Article 16. Force Majeure.

16.1. The Golf Club of Courchevel will not be responsible for the total or partial non-performance of its obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular in the event of a total or partial disturbance or strike, in particular by its logistics subcontractors, postal services, means of transport and/or communication, flooding or fire.

16.2. The Golf Club of Courchevel will inform the Customer of a force majeure event within 5 working days of its occurrence and will determine the processing methods of the order during the duration of the force majeure event.
Beyond a period of 1 month of interruption for force majeure, the Parties will be released from their obligations towards each other. If necessary, the Courchevel Golf Club will reimburse the Customer as soon as possible.
